SACRAMENTO - Today, Senator Tom Umberg (D-Santa Ana), Chair of the Senate Committee on Elections and Constitutional Amendments, presented Assembly Bill 860 (AB 860) as Joint Author on the Senate Floor. The bill passed the Senate floor with bipartisan support; a vote of 31 to 7. The bill will next be heard in the Assembly Committee on Elections and Redistricting.

SACRAMENTO, CA – Governor Gavin Newsom has signed Executive Order N-67-20, the second executive order issued to prepare for the administration of California’s November 3, 2020 General Election during the COVID-19 pandemic. Per the order, county elections officials will be required to offer a minimum of one in-person voting location for every 10,000 registered voters beginning October 31, the Saturday before Election Day.

Umberg (D - Santa Ana) issued a letter to the Orange County Board of Supervisors calling on them to put partisan posturing aside and fight side-by-side with state representatives to better ensure a fair share of the state’s resources in light of the current unprecedented global challenge brought on by the COVID-19 pandemic. Currently, state representatives of the Orange County delegation are working with Sacramento to secure necessary resources to protect public health and safely and reopen our economy.

(Sacramento, CA) – Today, Chair of the Senate Select Committee on the 2020 United States Census, Senator Thomas J. Umberg (D-Santa Ana) released the following statement regarding the 2020 Census during the current state of emergency inflicted by the COVID-19 crisis. The statewide effort to count each California resident will directly impact the next 10 years, and beyond. Resident counts are used to determine federal funding allocations to local school districts and to determine how many electoral college votes each community gets, among other political and daily-life impacts.

(Sacramento, CA) – Today, Senator Thomas J. Umberg (D-Santa Ana) debuted new legislation, in concert with Orange County District Attorney Todd Spitzer, and  San Diego County District Attorney Summer Stephan, to combat price gouging in the State of California during a declared state of emergency. In the midst of the COVID-19 pandemic, our state has seen countless examples of unscrupulous individuals using the crisis as an opportunity to turn a profit on essential goods and services. Senate Bill 1196 (SB 1196) will tighten California law to assist law enforcement officials in prosecuting instances of price gouging that are committed by new sellers during an emergency.

(Sacramento, CA) – Today, Senator Thomas J. Umberg (D-Santa Ana) released the following statement following recent reports in Orange and Los Angeles Counties of price gouging during the statewide public health emergency declaration in response to the COVID-19 pandemic in California. Senator Umberg reminds all Californians that, under California Penal Code Section 396, price gouging is illegal and punishable by law in all California communities during the declared state of emergency.

“Already, I have seen a number of cases of dramatically increased prices on goods like milk, cereal, cleaning materials and feminine hygiene products in my district (pictures attached). We cannot tolerate while those seeking to exploit an emergency for personal gains by taking advantage of their fellow Californians in a time of crisis,” said Senator Umberg. “There are clear-cut laws to defend our neighbors against price gouging, and we will enforce those laws to ensure that the many in need of supplies for themselves or their families are not left wanting.”

Price gouging refers to sellers trying to take unfair advantage of consumers during an emergency or disaster by greatly increasing prices for essential consumer goods and services. California’s anti-price gouging statute prohibits raising the price of many consumer goods and services by more than 10% after an emergency has been declared. Local laws may also contain their own prohibitions on price gouging. Violators are also subject to civil enforcement actions including civil penalties of up to $2,500 per violation, injunctive relief, and mandatory restitution.

“It is critical that the people of California are protected from those that prey on our community during the trying times of a national, and global, emergency,” said Senator Umberg. “We will work aggressively to prevent any scams that attempt to defraud disaster victims, and I encourage anyone who has been the recent victim of price gouging, or has information regarding price gouging, to immediately contact our District Office. We will work in concert with our Orange County Delegation partners, the Orange County District Attorney, and the State Attorney General to find justice for the people in our community.”
